Confidentiality, Access & Intellectual Property Notice

This document governs access to and use of the NutVision Orchard Management System (oms.nutvision.com), operated by Nisão, Lda. By accessing this platform, you unconditionally accept the terms set out below.
1. Restricted Access
This platform — oms.nutvision.com — is a private, password-protected system operated exclusively by Nisão, Lda for the management of authorised agricultural operations. Access is strictly limited to individuals who have been explicitly credentialled by Nisão, Lda or by a duly authorised Orchard Manager acting within the scope of their assigned permissions. Any attempt to access, probe, or interact with this system without valid authorisation constitutes unauthorised access and is a serious breach of applicable law.
2. Legal Framework
Unauthorised access to or use of this system may give rise to criminal and civil liability under, without limitation, the General Data Protection Regulation (EU) 2016/679 (GDPR), the Portuguese Cybercrime Law (Law No. 109/2009), the EU Directive on Attacks Against Information Systems (2013/40/EU), the EU Trade Secrets Directive (2016/943/EU), and all applicable national and international instruments governing corporate confidentiality, data protection, and computer fraud. Nisão, Lda reserves the right to pursue all available legal remedies, including injunctive relief and claims for damages, against any party found to have accessed or misused this system without authorisation.
3. Confidentiality of Information
All information accessible through this system — including but not limited to operational data, agronomic records, yield and quality metrics, parcel maps and boundaries, user data, financial indicators, and any associated analyses or reports — constitutes strictly confidential and proprietary information belonging to Nisão, Lda and/or its clients. Authorised users acknowledge that they access this information solely for the purposes for which access has been granted and that they bear a continuing duty of confidentiality both during and following the period of their authorised use.
4. Intellectual Property
The entirety of this platform — encompassing its design, architecture, user interface, workflows, report structures and formats, data models, and all associated content — constitutes the exclusive intellectual property of Nisão, Lda. No element of this system may be reproduced, copied, adapted, distributed, transmitted, published, or otherwise exploited, in whole or in part, in any form or by any means, whether electronic, mechanical, or otherwise, without the prior express written authorisation of Nisão, Lda. Breach of this provision may give rise to claims for infringement under Portuguese and European Union intellectual property law.
5. Conditions of Authorised Use
By accessing this system, each authorised user unconditionally agrees: (a) to use the system solely for its intended operational purposes; (b) not to share, disclose, or transmit their access credentials to any third party; (c) not to copy, export, or retain system data beyond what is strictly necessary for their authorised function; (d) to notify Nisão, Lda immediately upon becoming aware of any actual or suspected unauthorised access or security breach; and (e) to comply with all applicable laws, regulations, and internal policies governing the use of this system and the information it contains.
6. Monitoring & Audit
All activity on this platform is logged and may be monitored for security, operational, and compliance purposes. Access logs, session records, and user activity data are retained in accordance with applicable data protection legislation. By using this system, authorised users expressly consent to such monitoring. Any evidence of misuse or unauthorised activity may be disclosed to competent authorities and used in legal proceedings.
